The Interim Final Rule was set aside on December 1, 2020 by order of U.S. District Court for the Northern District of California in ITServe Alliance, Inc., et al. v. Scalia, et al., No. 20cv14604. Therefore, the correct Prevailing Wage amount of 101,213 has been entered for the assigned wage level.br br Note that advertisements expire within the next few days. The Regulations allow for advertisements to run while a prevailing wage request is pending. The Interim Final Rule IFR was set aside and we find no value in waiting for the redetermination when we are following the wage level and wage category already set in the Prevailing Wage Determination. We believe the judge who decided the ITServe Alliance case would take issue if cases are unnecessarily delayed or denied while waiting for a wage redetermination.
