For this job of Chinese Lead Classroom Teacher Elementary, the requirement for fluency in language is normal to the job. This is addressed by the Prevailing Wage Determination Guidance. Page 12 of the Guidance states specifically that A language requirement . . . shall generally be considered a special skill for all occupations, with the exception of foreign language teachers. All Chinese Lead Classroom Teachers teach multiple elementary level subjects including language arts, and also teach Chinesebr by teaching all subjects in Chinese. Therefore, this application for labor certification is for a foreign language teacher, and the language requirement is a normal requirement and not a special requirement. The schools curriculum is aligned with the ACTFL American Council on the Teaching of Foreign Languages Language Proficiency Guidelines, Common Core State Standards, and Next Generation Science Standards. Additionally, by teaching all subjects in Chinese, the Chinese Lead Classroom Teacher is performing teaching that is critical to the entire education and business model of Yu Ming Charter School. At Yu Ming Charter School, students in kindergarten through 5th grade learn a majority of subjects in Mandarin Chinese. Therefore, the job requirements for fluency in Mandarin Chinese is normal, it certainly bears a reasonable relationship to the occupation of Chinese Lead Classroom Teacher Elementary in the context of our business, and this requirement is essential to perform the job in a reasonable manner.
