Moreover, the foreign national possesses two years of experience as a Law ClerkJunior Associate, Unassigned practicing Corporate and Private Funds Law. Specifically, she was employed as a Law ClerkJunior Associate, Unassigned at Paul, Weiss, Rifkind, Wharton Garrison LLP from September 5 2015 to December 31 2017. This experience includes fund formation for private equityhedge fund clients and MA transactions for investment management firms. Please note that the positions of Law ClerkJunior Associate, Unassigned Group are not substantially comparable to the position of MidLevel Associate, Private Funds Group the job opportunity as the positions require the performance of different job duties in excess of 50 of the time.br br As a Law Clerk and Junior Associate in the firms Unassigned Group, the foreign national provided support to more senior attorneys in connection with general corporate matters, as well as private funds matters. Using form agreements, she prepared individualized documents, conducted legal due diligence and legal research and performed document review. The Law Clerk and Junior Associate positions are essentially internal support roles, and involve little to no client contact. They also do not involve the provision of direct legal advice to clients. All work is rigorously scrutinized by more senior associates and partners. Moreover, the position involves no responsibility in negotiating or drafting primary legal agreements.br br In stark contrast, as a MidLevel Associate, the foreign national focuses entirely on private funds matters and directly represents and advises clients with respect to complex private funds issues. She provides advice on clients offering and marketing materials and directly negotiates with investors. She further provides advice to clients directly on company arrangements, compensation and strategic partnerships. She also directly negotiates governing agreements and advises on regulatory and compliance issues. She further interacts on behalf of clients with US regulatory bodies such as the SEC and the CFTC. Moreover, this position involves supervision of junior attorneys and legal support professionals.br br Please see Section K.9 for additional details. Accordingly, the foreign national meets the requirements for the job opportunity.br br Regarding Section H.12, please note that the employers requirements for the position are normal. First, as indicated by DOLs ONET source, the Lawyer occupation requires a JD or LL.M and several years of experience.
