We respectfully note that the laid off worker is not potentially qualified U.S. worker and, therefore, DOLs notification and consideration requirement is not triggered. Specifically, the Conduent manager who had direct knowledge of the laid off workers experience and the essential job duties involved in the occupation for which certification was sought, evaluated the laid off workers qualifications. Based on the Managers careful evaluation of the laid off workers qualifications, it was determined that the laid off worker was not a potentially qualified worker. Thus, since the laid off worker was not a potentially qualified worker, the notice and consideration requirement was not required in accordance with DOLs rules.
