Oral and written Spanish language proficiency.br Employment contingent on passing drug test.br See section K.9 Addendum for foreign workers skills and certification acquisition information.br br NOTES TO CLARIFYbr br BUSINESS NECESSITY FOR FOREIGN LANGUAGE REQUIREMENTbr Oral and written proficiency in the Spanish language is necessary because majority of the students in this teaching positions classroom speak only Spanish. Employer School District is required by Texas law to offer a bilingual education program to students of Limited English Proficiency LEP or English Learners EL in prekindergarten PreK through fifth grade. LEP or EL student is a student whose primary language is otherbr than English and whose English language skills are such that the student has difficulty performing ordinary classwork in English. Under Texas law, a bilingual education program must be a fulltime program of duallanguage instruction that provides for learning basic skills in the primary language of the students enrolled in the program and for carefully structured and sequenced mastery of English language skills. The bilingual classrooms are typically composed entirely of English Learner students. Texas school districts must assign appropriately certified teachers to the statutorily required Bilingual education programs.br Employer School District currently serves over 3,000 students in elementary grade levels through the bilingual and ESL programs. The School District has adopted a LateExit Transitional bilingual model of instruction, which progressively reduces the time spent teaching in Spanish and increases the time spent teaching in English as the students get promoted to the next grade level. Thus, in PreKindergarten, 90 of the instruction is delivered in Spanish, and only 10 is delivered in English; by the timebr the students reach Fifth grade, the percentage of time reverses to 10 of the instruction being in Spanish, and the remaining 90 being in English. Since instruction in a bilingual classroom is delivered using the students native language Spanish and the English language, knowledge of and competency in the Spanish language is necessary for a Bilingual educator in Employer School District. This language skill requirement does not sufficiently increase the seniority andor complexity of this position, asbr compared to other elementary school teachers. Bilingual certified teachers receive a salary supplement a bilingual stipend to account for this extra requirement.br br EXPLANATION OF TEACHER CERTIFICATION REQUIREMENTbr The special requirement of teacher certification in Bilingual EducationSpanish for elementary grades cannot be obtained through a reasonable period of onthejob training. The certification is required by the State of Texas prior to being able to work with public school students. Texas Education Code, at Title 2, Section 21.003a, states A person may not be employed as a teacher . . . by a school district unless the person holds an appropriate certificate or permit issued in accordance with thebr Texas Education Code and regulations. Our School District does not provide any training to become a certified teacher.
