Specifically, the Conduent manager who had direct knowledge of the laid off workers experience and the essential job duties involved in the occupation for which certification was sought, evaluated the laid off workers qualifications. Based on the Managers careful evaluation of the laid off workers qualifications, it was determined that the laid off workers were not potentially qualified workers. Thus, since the laid off workers were not potentially qualified workers, the notice and consideration requirement was not required in accordance with DOLs rules.
