Per DOL regulations, only potentially qualified U.S. workers must be notified and considered for the job opportunity. We respectfully note that ATT laid off 4 workers in the 6 month period prior to filing the PERM application. On 03312023, Certified Letters with Return Receipt Requested were sent to the last known address, as per company records, of 4 potentially qualified laidoff workers. The letters provided a full description of the specific job opportunity and invited each laidoff worker to apply for the position. As a result of this effort, 1 of the laidoff worker applied for the job opportunity and each applicant was considered and evaluated according to the specific requirements of the position. The ATT manager carefully reviewed all interested laidoff U.S. worker qualifications and determined that they did not meet the minimum requirements of the position and would not be able to perform the job duties given a reasonable period of training. Thus, as ATT notified all potentially qualified laidoff employees of the job opportunity and concluded there were no qualified applicants after careful consideration, the notice and consideration requirements were met in accordance with DOLs rules.
