Further explanation regarding the newspaper advertisements described herein Per 20 CFR 656.17 e 2 ii, an employer filing Form ETA9089 on behalf of a candidate in a nonprofessional occupation is required to place an advertisement on two Sundays in the newspaper of general circulation in the area of intended employment most appropriate to the occupation and the workers likely to apply for the job opportunity and most likely to bring responses from available U.S. workers.br br The employer made a good faith effort to recruit U.S. workers by placing advertisements in the Bangor Daily News, which publishes 6 days a week Monday through Friday and then a single SaturdaySunday edition; the employers advertisements appeared in two SaturdaySunday editions. The Bangor Daily News is the newspaper of general circulation for the area of intended employment, which is in Old Town, Maine. Old Town is about 10 miles north of Bangor and both are within Penobscot County, which comprises the Bangor, ME MSA.br br Thus, in this case, the Bangor Daily News SaturdaySunday edition is functionally the equivalent of a Sundayonly newspaper edition. See, In the Matter of Earthbound Farm, 2012PER00287 May 9, 2014. It is not a mere weekly publication that remains in distribution throughout a weekend, but rather a local newspaper that publishes six days out of the week, with the sixth date of publication explicitly stated to be a twoday weekend edition covering both Saturday and Sunday. Id. The Bangor Daily News is not a small secondary newspaper published in the suburbs when a major metropolitan areas largest newspaper is also available. Rather, it is the most widelycirculated newspaper in the area of intended employment. It is the newspaper used in the Bangor area on the weekends for classified advertisements and the purpose of the weekend edition is essentially indistinguishable from a local newspaper that runs a unique Sunday edition. In other words, if you live in or are seeking a job in Bangor, Old Town, or the surrounding area and are looking for classified job announcements, the Bangor Daily News SaturdaySunday edition serves exactly the same purpose as a Sunday only newspaper edition.
