Per DOL regulations, only potentially qualified U.S. workers must be notified of the job opportunity. Conduent did have six layoffs in the Manager II occupation in the Austin area, however none of those laid off were in the same position as the position listed on the PERM. In addition, the manager of each of the laid off workers reviewed the requirements of the position and confirmed that each of the laid off workers were not qualified for the position. We respectfully note that the laid off workers are not potentially qualified U.S. workers and, therefore, DOLs notification and consideration requirement is not triggered. Specifically, the laid off workers Conduent managers, who had direct knowledge of the laid off workers experience and the essential job duties involved in the occupation for which certification was sought, evaluated the laid off workers qualifications. Based on the Managers careful evaluation of the laid off workers qualifications, it was determined that the laid off workers were not potentially qualified workers. Thus, since the laid off workers were not potentially qualified workers, the notice and consideration requirement was not required in accordance with DOLs rules.
